1. Agreement
These Terms and Conditions govern your access to and use of TwinStow. TwinStow is operated by Newcastle AI Pty Ltd. By creating an account, accessing, or using TwinStow, you agree to these terms. If you do not agree, do not use the service.
2. Service Description
TwinStow provides cloud storage and related features for file backup, storage, and recovery. Service features may change over time and may be interrupted for maintenance, security, or technical reasons.
3. Customer Responsibilities
You are responsible for maintaining your own backup strategy, retaining local copies where appropriate, protecting your account credentials, and confirming that your use of TwinStow complies with all applicable laws.
4. Fees and Payment (Stripe)
Paid services are billed via Stripe. By using paid services, you authorise Newcastle AI Pty Ltd and its payment processor Stripe to charge your nominated payment method for storage, retrieval, and any other applicable service charges.
Unless stated otherwise, all pricing is in AUD. A minimum spend of $1 AUD per month applies. If payment cannot be processed, we may suspend or limit access to paid features until outstanding amounts are paid.
Except where required by law (including Australian Consumer Law), fees are non-refundable.
5. No Warranty
To the maximum extent permitted by law, TwinStow is provided on an "as is" and "as available" basis. We do not warrant uninterrupted availability, error-free operation, or that stored content will always be recoverable.
6. Limitation of Liability
To the maximum extent permitted by law, TwinStow and its personnel are not liable for any indirect, incidental, special, punitive, or consequential loss, including loss of data, loss of profits, loss of goodwill, business interruption, or costs of restoring data.
To the maximum extent permitted by law, our total aggregate liability to you for any claim arising out of or in connection with the services is limited to the total fees actually paid by you to TwinStow for the relevant services during the 12 months immediately preceding the event giving rise to the claim.
7. Australian Consumer Law
Nothing in these terms excludes, restricts, or modifies any non-excludable rights or remedies you may have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.
8. Governing Law
These terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts that may hear appeals from them.
9. Changes to Terms
We may update these terms from time to time. Continued use of TwinStow after updated terms become effective constitutes acceptance of those changes.
